Causing sexual activity without consent
It is an offence to cause or encourage another person to engage in sexual activity without his or her consent. If penetration is involved the maximum penalty is imprisonment for life. If not, the maximum penalty is imprisonment for ten years.
Consent
Consent (i.e. agreement) must be clearly established between two people before any kind of sexual act or behaviour. If an individual is accused of a sex offence, they must show that they reasonably believed consent had been given by the other person.
