I'm in debt up to my ears; I'm considering bankruptcy but my landlord has threatened to throw me out of the house because my actions will affect his ability to get another mortgage. He thinks my actions will also affect the others in the house if they try to get a mortgage. Is this true?

Answer

Your landlord is partly right. If you go bankrupt there could be a knock-on effect to the landlord and the other tenants living at your address. But there's now a presumption that there is no connection between people of different surnames living at the same address. This was laid down in guidelines in 1993.

You may want to contact the relevant credit reference agencies and ask them to amend their files, so that any assumed link between you and your landlord is broken. The agencies are: Experian Limited (tel: 0844 481 8000), Equifax plc (tel: 0844 335 0550) and Callcredit plc (tel: 0870 0601 414)
