Is it against the law to not give an employee a wage slip?
Answer
Most employees have a statutory right to an itemised payslip, but if you fall into one of the categories below then your employer does not have to give you one:
- Anyone who's not an employee, for example, an independent contractor or freelance agent
- An employee who ordinarily works outside the UK under their contract of employment
- Members of the police service
- Merchant seamen and share fisherman
If you're not in one of these categories, your employer should give you a payslip. If they don't, you can take a case to an Employment Tribunal to get the company to provide one. If the company dismisses you for trying to get a payslip you can make a claim for automatic unfair dismissal.
It's also possible that by not giving you a payslip the company may be defrauding HMRC. If you believe this is the case you should report the situation to HMRC. Otherwise you could be implicated in the fraud.
It could also be that you are working under an illegal contract of employment and if this is the case you may not have employment protection rights.
