Ex marks the debt

Question

I've received a letter addressed to my ex demanding payment for credit card debts. I had a card on the same account but never used it. Can I be held liable for the money she spent?

Answer

Since the card is in your ex's name she is responsible for the debts attached to it. If she believes that some of the debts are yours, then she will have to make a claim against you and prove this to be the case.

In the meantime, you should tell the credit card company that she is no longer at your address and either cut up the additional card you have or return it to them (depending on the company policy).

If bailiffs were to call, you can explain that your ex is no longer at that address and give her new address if you have it.

You might also want to contact the credit reference agencies to inform them that your ex is no longer resident at your address. The agencies are: Experian (0870 241 6212); Equifax (0870 010 0583); and Callcredit (Tel: 0870 060 1414).
