Question

I've just been offered a dream job, but before I can get it I've got to fill in a load of forms, including a 'health assessment'.

The form asks if I've got a history of mental health problems. In the past I've self harmed and been treated for depression and I'm scared that if I'm honest I won't get the job.

I have to sign a declaration saying I've answered the questions honestly and I can be fired if I lie. What should I do?

Answer

You have very little option other than to be honest when completing your application form. The disclaimer means that if you're not completely honest you could face the sack. In an extreme situation it would even be possible for the company to go to the police and have you charged with fraud if you lied and declared to the contrary.

Just because you admit that there is a problem doesn't mean that you won't get the job. A company must not discriminate against you on the grounds of a disability. If you don't get the job and believe you've been discriminated against you could take action against them at an Employment Tribunal through on the grounds of disability discrimination, providing your condition is recognized under the Disability Discrimination Act.

You may also want to discuss you situation with Acas (the Advisory, Conciliation and Arbitration Service) and the Equality and Human Rights Commission
